These Terms of Use govern access to and use of Cyber Company Profiles located at cybercompanyprofiles.com (the "Site"), including all profiles, scores, commentary, data, graphics, and other materials made available through the Site. The Site is operated by Zeltser Security Corp. References to "we," "us," and "our" mean Zeltser Security Corp. By accessing or using the Site, you agree to these Terms and our Privacy Policy. If you use the Site on behalf of an organization, you represent that you have authority to accept these Terms on its behalf. If you do not agree to these Terms, do not access or use the Site.
Cyber Company Profiles publishes research and commentary concerning cybersecurity companies using Lenny Zeltser's product-strategy frameworks. Profiles contain factual statements drawn from third-party sources. We do not represent that those sources are complete, current, or independently verified. Each score and the conclusions expressed in the accompanying analysis reflect analytical opinions developed under the Site's methodology, not statements of objective fact or evaluations of the quality of the company's products or services. Other analysts may review the same information and reach different conclusions.
Profiles are generated through automated tools, including artificial intelligence, that gather, summarize, and analyze publicly available information. Unless a profile states otherwise, it has not been reviewed by a human. Automated analysis may contain errors of fact, context, interpretation, or judgment. The sources used may include company materials, public filings, press coverage, and industry publications. Those sources may change, be superseded or removed, or later be shown to be inaccurate. A profile may not reflect the most current information about a company, and we have no obligation to update any profile on a particular schedule. Unless expressly stated, profiles are not based on hands-on use or testing of any products or services. We do not independently validate technical performance, security controls, customer results, or claims made by the company or third parties.
The Site is a research aid; it is not a substitute for professional advice or independent diligence. Nothing on the Site is a cybersecurity audit report, product review, investment report, procurement recommendation, or custom diligence report. Nothing on the Site recommends whether you should transact with any profiled company. Any information you intend to act upon should be checked against the company's current materials and other sources appropriate to your circumstances. Use of the Site does not create an advisory, consulting, fiduciary, professional, or client relationship with Zeltser Security Corp. or Lenny Zeltser.
Some content is available without charge. Other content may be accessed by purchasing an individual profile or a catalog pass. The content included in a purchase, the applicable access period, and the price will be shown at checkout. Lemon Squeezy acts as merchant of record and authorized reseller for purchases made through the Site. Your payment transaction, including payment processing, taxes, refunds, and chargebacks, is subject to Lemon Squeezy's buyer terms. Zeltser Security Corp. provides and licenses access to the purchased content. Unless stated otherwise at checkout, a purchase provides access for 12 months, subject to the continued operation of the Site and these Terms, and does not renew automatically. During that period, you may save or print a copy for your permitted use. You may keep and use those copies after the access period ends, subject to Sections 6 through 8. This right ends if we terminate your access under Section 11 or the purchase is fully refunded. We do not promise that the Site or any profile will remain available indefinitely.
Prices may change for future purchases. Checkout will require acceptance of these Terms, and we may retain a record of the version accepted. An individual-profile purchaser may request a refund within 14 days after purchase. A catalog-pass purchaser may request a refund within 72 hours after purchase. Refund requests must be submitted to the email address provided in Section 17 and are subject to applicable law and Lemon Squeezy's buyer terms and processing requirements. We may decline a request where there is evidence of fraud, systematic downloading, credential sharing, or other misuse.
Subject to these Terms, we grant you a limited, non-exclusive, and non-transferable right to access and use the Site and purchased content for personal or internal business purposes during the applicable access period, and afterward to keep and use saved copies as Section 4 provides. An organization that purchases access may make the content available to personnel within that organization who reasonably need it for those purposes. The organization remains responsible for their compliance with these Terms. Except for the internal organizational use permitted above, you may not publish, distribute, or otherwise make the content available to any third party. You may not sell, sublicense, syndicate, or otherwise make the content available to another person or entity. Access credentials may not be shared, and no person may circumvent a paywall or other access control. A share link may be used only by the person for whom it was created. Share links are revocable and do not transfer any right to the underlying content.
You may not use automated means to scrape, crawl, harvest, monitor, download, or copy the Site or its content. This restriction does not prohibit an AI assistant or similar automated tool, acting on behalf of an individual user, from retrieving and analyzing content that the user is entitled to view at the time of access, through the features the Site expressly provides for that purpose, such as its markdown exports and share links. You are responsible for the tool's compliance with these Terms. This exception applies only to the first sentence of this Section; every other restriction in these Terms continues to apply to that use. You may not collect profiles or data in bulk. You may not use the content to train, fine-tune, test, evaluate, or improve a machine-learning or artificial-intelligence system without our written permission. You also may not use the content to create substitute profiles or to build or support a competing database, research product, scoring system, or service.
The Site and its original content are owned by Zeltser Security Corp. or its licensors. This includes the profiles, scores, commentary, graphics, site design, compilations, and product-strategy frameworks. They are protected by copyright, trademark, and other applicable laws. These Terms grant only the limited right of use stated above. No ownership or other intellectual-property right is transferred to you. You may not remove or obscure any copyright, attribution, trademark, or proprietary notice.
The Site may link to or quote from third-party materials for source support, identification, and commentary. We do not control those materials and are not responsible for their accuracy, availability, policies, or practices. A link does not mean that we endorse the source or that the source endorses us. Company names, product names, logos, trademarks, and service marks belong to their respective owners. They are used to identify and discuss the companies and products described. Their appearance does not imply sponsorship, approval, authorization, or affiliation.
A user or profiled company may report a claimed factual error through the Site's Report an Error function or by contacting us directly. The submission should identify the statement at issue and provide supporting information. We may investigate, correct, annotate, update, or remove content in our discretion. We are not required to change an analytical opinion because a user or profiled company disagrees with it. A correction or other change is not an admission that the original content was false, defamatory, misleading, or otherwise improper. Do not submit confidential, proprietary, or security-sensitive information through the correction process. Profiled companies cannot pay to influence coverage, obtain favorable treatment, increase a score, remove criticism, or suppress competitors. If Zeltser Security Corp. has a material commercial relationship with a profiled company that could reasonably affect a user's evaluation of the profile, that relationship will be disclosed in connection with the profile.
We may change, update, suspend, or discontinue any part of the Site or its content. We do not promise uninterrupted access or continuing availability of any particular profile. We may restrict or terminate access if we reasonably believe that a user has violated these Terms, compromised Site security, shared paid access without authorization, or used the Site in a manner that may harm us or another person. A user whose access is terminated for violating these terms will not be entitled to a refund. The provisions concerning ownership, use restrictions, disclaimers, liability, indemnification, and disputes survive termination.
THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, ZELTSER SECURITY CORP. DISCLAIMS ALL EXPRESS AND IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, AND CURRENCY. WE DO NOT WARRANT THAT THE SITE OR ANY PROFILE WILL BE CORRECT, COMPLETE, CURRENT, UNINTERRUPTED, SECURE, OR ERROR-FREE. WE DO NOT WARRANT THE ACCURACY OF THIRD-PARTY SOURCES OR THE RESULTS OF AUTOMATED ANALYSIS. YOU ASSUME RESPONSIBILITY FOR YOUR USE OF THE SITE AND FOR ANY DECISION BASED IN WHOLE OR IN PART ON ITS CONTENT.
Some jurisdictions do not permit certain warranty exclusions. In those jurisdictions, the exclusions apply only to the extent permitted by law.
TO THE FULLEST EXTENT PERMITTED BY LAW, ZELTSER SECURITY CORP., LENNY ZELTSER, AND THEIR OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO THE SITE, ANY PROFILE, ANY THIRD-PARTY SOURCE, OR YOUR USE OF OR RELIANCE ON THE CONTENT. THIS EXCLUSION INCLUDES LOST PROFITS, LOST BUSINESS, LOST OPPORTUNITIES, LOSS OF DATA, AND REPUTATIONAL HARM. THESE EXCLUSIONS APPLY REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF THE POSSIBILITY OF THE LOSS WAS KNOWN OR FORESEEABLE. OUR TOTAL LIABILITY ARISING FROM OR RELATING TO THE SITE, THE CONTENT, A PURCHASE, OR THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PROFILE OR CATALOG PASS GIVING RISE TO THE CLAIM.
These limitations do not apply to liability that cannot be excluded or limited under applicable law.
You agree to indemnify, defend, and hold harmless Zeltser Security Corp., Lenny Zeltser, and their officers, employees, contractors, and agents from and against any third-party claim, and any resulting losses, liabilities, costs, expenses, and reasonable attorneys' fees, arising from your material breach of these Terms, unauthorized use or distribution of the content, violation of law, or infringement of another person's rights. We may assume control of the defense of a claim subject to indemnification. You will reasonably cooperate in that defense and may not settle the claim in a manner that admits liability by or imposes an obligation on an indemnified party without our written consent.
These Terms and any dispute with Zeltser Security Corp. arising from the Site, its content, or access provided by us are governed by New York law, without regard to conflict-of-law rules. Any such dispute must be brought exclusively in the state courts located in New York County, New York, or the federal courts located in the Southern District of New York. Each party consents to the jurisdiction and venue of those courts.
We may revise these Terms by posting an updated version on the Site. Changes apply to use of the Site after the stated effective date. The version accepted when you purchase an individual profile or catalog pass will govern that purchase, its access period, and the applicable refund policy. A later change will not retroactively alter those terms unless required by law or accepted by you. Your continued use of the Site after the effective date of an updated version constitutes acceptance of the updated Terms.
These Terms, the Privacy Policy, and any terms presented at checkout constitute the agreement between you and Zeltser Security Corp. concerning the Site and its content. If any provision is held unenforceable, the remaining provisions will remain in effect. A failure to enforce a provision is not a waiver. You may not assign your rights under these Terms without our written consent. We may assign these Terms in connection with a merger, reorganization, sale of the business or its assets, or by operation of law.
