These Terms of Use govern access to and use of Cyber Company Profiles located at cybercompanyprofiles.com (the "Site"), including all profiles, scores, commentary, data, graphics, and other materials made available through the Site. The Site is operated by Zeltser Security Corp. References to "we," "us," and "our" mean Zeltser Security Corp. By accessing or using the Site, you agree to these Terms and our Privacy Policy. If you use the Site on behalf of an organization, you represent that you have authority to accept these Terms on its behalf. If you do not agree to these Terms, do not access or use the Site.
Cyber Company Profiles publishes research and commentary concerning cybersecurity companies using Lenny Zeltser's product-strategy frameworks. Profiles contain factual statements drawn from third-party sources. We do not represent that those sources are complete, current, or independently verified. Each score and the conclusions expressed in the accompanying analysis reflect analytical opinions developed under the Site's methodology, not statements of objective fact or evaluations of the quality of the company's products or services. Other analysts may review the same information and reach different conclusions.
Profiles are generated through automated tools, including artificial intelligence, that gather, summarize, and analyze publicly available information. Unless a profile states otherwise, it has not been reviewed by a human. Automated analysis may contain errors of fact, context, interpretation, or judgment. The sources used may include company materials, public filings, press coverage, and industry publications. Those sources may change, be superseded or removed, or later be shown to be inaccurate. A profile may not reflect the most current information about a company, and we have no obligation to update any profile on a particular schedule. Unless expressly stated, profiles are not based on hands-on use or testing of any products or services. We do not independently validate technical performance, security controls, customer results, or claims made by the company or third parties.
The Site is a research aid; it is not a substitute for professional advice or independent diligence. Nothing on the Site is a cybersecurity audit report, product review, investment report, procurement recommendation, or custom diligence report. Nothing on the Site recommends whether you should transact with any profiled company. Any information you intend to act upon should be checked against the company's current materials and other sources appropriate to your circumstances. Use of the Site does not create an advisory, consulting, fiduciary, professional, or client relationship with Zeltser Security Corp. or Lenny Zeltser.
All content on the Site is available without charge. This includes the full profiles, the machine-readable markdown and JSON exports, and the whole-corpus archive described in Section 6. No purchase, registration, account, or credential is required to access any content. You may save or print copies of the content for the uses Section 5 permits and may keep and use those copies afterward, subject to Sections 5 through 7. This right ends if we terminate your license under Section 10. We do not promise that the Site, any profile, or any export will remain available indefinitely or in any particular form.
Subject to these Terms, we grant you a free-of-charge, limited, non-exclusive, and non-transferable license to access and use the Site and its content for personal use and internal business purposes. Internal business purposes include internal commercial evaluation, such as assessing a vendor for procurement, researching a market or competitor, or supporting partnership or investment diligence, and include making the content available to personnel within your organization who reasonably need it for those purposes. The organization remains responsible for their compliance with these Terms.
You may quote or excerpt portions of the content in your own work, with attribution to cybercompanyprofiles.com, provided that you do not reproduce a complete profile or a substantial portion of any profile, do not make systematic excerpts that individually or together amount to a substantial portion of the corpus, and do not produce a work that serves as a substitute for the Site.
Except as this Section and Section 6 expressly permit, you may not sell, resell, sublicense, syndicate, or republish the content or any substantial portion of it; you may not distribute the content, or any substantial portion of it, as a standalone dataset, corpus, or archive; and you may not otherwise make the content available to third parties. You may not incorporate the content into, or use it to create, populate, operate, or materially enhance, a substitute set of profiles or a database, research product, scoring system, or other product or service that competes with the Site. Ordinary internal market or competitor research that does not incorporate or expose the content in such a product or service remains permitted. All rights not expressly granted are reserved.
The Site publishes machine-readable surfaces expressly intended for automated use, including its markdown and JSON exports, its catalog manifest, and its whole-corpus archive. You may use automated means, including AI assistants, agents, and crawlers, to retrieve and analyze content through those surfaces or through ordinary access to the Site's public pages. For clarity, this permission includes downloading and privately storing the whole-corpus archive for the personal and internal business uses Section 5 permits, and it covers the copies technically necessary for retrieval, storage, indexing, and analysis. It does not authorize publication, transmission to third parties, distribution as a dataset, or reproduction of a substantial portion of the content in any output.
An AI assistant or similar automated tool acting on behalf of a user may retrieve, analyze, summarize, and quote content for that user, subject to the attribution, substantial-portion, non-substitution, and non-distribution limits in Section 5; the user is responsible for the tool's compliance with these Terms. Automated retrieval does not enlarge the license granted in Section 5. You may not use automated means to circumvent an access control or other technical protection measure, to probe, disrupt, or degrade the Site, or to impose an unreasonable load on its infrastructure.
You may not use the content, or any substantial portion of it, directly or through derived or synthetic data, as training data to train, fine-tune, continue the pretraining of, or distill a machine-learning or artificial-intelligence model, or otherwise to develop or modify a model's weights or parameters, without our written permission. You may not authorize a service provider to retain or use content you submit to it for the provider's own model training or other purposes unrelated to serving you. These restrictions do not prohibit using an AI system at inference time to retrieve, privately index, analyze, summarize, or quote content for a purpose Section 5 permits, provided the resulting output complies with Section 5. The prohibition in Section 5 on competing products and services applies equally to content retrieved by automated means, including the creation of substitute profiles.
The Site and its original content are owned by Zeltser Security Corp. or its licensors. This includes the profiles, scores, commentary, graphics, site design, compilations, and product-strategy frameworks. They are protected by copyright, trademark, and other applicable laws. These Terms grant only the limited right of use stated above. No ownership or other intellectual-property right is transferred to you. You may not remove or obscure any copyright, attribution, trademark, or proprietary notice.
The Site may link to or quote from third-party materials for source support, identification, and commentary. We do not control those materials and are not responsible for their accuracy, availability, policies, or practices. A link does not mean that we endorse the source or that the source endorses us. Company names, product names, logos, trademarks, and service marks belong to their respective owners. They are used to identify and discuss the companies and products described. Their appearance does not imply sponsorship, approval, authorization, or affiliation.
A user or profiled company may report a claimed factual error through the Site's Report an Error function or by contacting us directly. The submission should identify the statement at issue and provide supporting information. We may investigate, correct, annotate, update, or remove content in our discretion. We are not required to change an analytical opinion because a user or profiled company disagrees with it. A correction or other change is not an admission that the original content was false, defamatory, misleading, or otherwise improper. Do not submit confidential, proprietary, or security-sensitive information through the correction process. Profiled companies cannot pay to influence coverage, obtain favorable treatment, increase a score, remove criticism, or suppress competitors. If Zeltser Security Corp. has a material commercial relationship with a profiled company that could reasonably affect a user's evaluation of the profile, that relationship will be disclosed in connection with the profile.
We may change, update, suspend, or discontinue any part of the Site or its content. We do not promise uninterrupted access or continuing availability of any particular profile. We may restrict, block, or terminate access, and may terminate the license granted in Section 5, if we reasonably believe that a user has violated these Terms, compromised Site security, or used the Site in a manner that may harm us or another person. The provisions concerning ownership, use restrictions, disclaimers, liability, indemnification, and disputes survive termination or your ceasing to use the Site.
THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, ZELTSER SECURITY CORP. DISCLAIMS ALL EXPRESS AND IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, AND CURRENCY. WE DO NOT WARRANT THAT THE SITE OR ANY PROFILE WILL BE CORRECT, COMPLETE, CURRENT, UNINTERRUPTED, SECURE, OR ERROR-FREE. WE DO NOT WARRANT THE ACCURACY OF THIRD-PARTY SOURCES OR THE RESULTS OF AUTOMATED ANALYSIS. YOU ASSUME RESPONSIBILITY FOR YOUR USE OF THE SITE AND FOR ANY DECISION BASED IN WHOLE OR IN PART ON ITS CONTENT.
Some jurisdictions do not permit certain warranty exclusions. In those jurisdictions, the exclusions apply only to the extent permitted by law.
TO THE FULLEST EXTENT PERMITTED BY LAW, ZELTSER SECURITY CORP., LENNY ZELTSER, AND THEIR OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM OR RELATING TO THE SITE, ANY PROFILE, ANY THIRD-PARTY SOURCE, OR YOUR USE OF OR RELIANCE ON THE CONTENT, WHETHER DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE. THIS EXCLUSION INCLUDES LOST PROFITS, LOST BUSINESS, LOST OPPORTUNITIES, LOSS OF DATA, AND REPUTATIONAL HARM. IT APPLIES REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF THE POSSIBILITY OF THE LOSS WAS KNOWN OR FORESEEABLE.
Nothing in these Terms excludes or limits liability for gross negligence, willful misconduct, or any other liability that applicable law does not permit to be excluded or limited.
You agree to indemnify, defend, and hold harmless Zeltser Security Corp., Lenny Zeltser, and their officers, employees, contractors, and agents from and against any third-party claim, and any resulting losses, liabilities, costs, expenses, and reasonable attorneys' fees, arising from your material breach of these Terms, unauthorized use or distribution of the content, violation of law, or infringement of another person's rights. We may assume control of the defense of a claim subject to indemnification. You will reasonably cooperate in that defense and may not settle the claim in a manner that admits liability by or imposes an obligation on an indemnified party without our written consent.
These Terms and any dispute with Zeltser Security Corp. arising from the Site, its content, or access provided by us are governed by New York law, without regard to conflict-of-law rules. Any such dispute must be brought exclusively in the state courts located in New York County, New York, or the federal courts located in the Southern District of New York. Each party consents to the jurisdiction and venue of those courts.
We may revise these Terms by posting an updated version on the Site with a new effective date. Changes apply to use of the Site after the stated effective date. A change will not retroactively alter rights or obligations that arose before it unless required by law or accepted by you. Your continued use of the Site after the effective date of an updated version constitutes acceptance of the updated Terms. If you do not agree to an updated version, do not continue to use the Site.
These Terms and the Privacy Policy constitute the agreement between you and Zeltser Security Corp. concerning the Site and its content. If any provision is held unenforceable, the remaining provisions will remain in effect. A failure to enforce a provision is not a waiver. You may not assign your rights under these Terms without our written consent. We may assign these Terms in connection with a merger, reorganization, sale of the business or its assets, or by operation of law.
